This Agreement governs the relationship between Fazal (“Designer”) and the Client (“You”) regarding website design and development services. By engaging in these services, both parties agree to the following:

1. Scope of Services

I specialize in creating digital solutions for wellness professionals, including:

  • Custom Design & Development: Tailored WordPress or Wix Studio builds.
  • Optimization: Basic SEO and performance configuration.
  • Support: Hosting setup, instructional training, and post-launch maintenance.

2. Project Timelines & Milestones

Project delivery is contingent upon client responsiveness and content availability.

  • Simple Projects: 7–10 Business Days.
  • Standard Builds: 2–4 Weeks.
  • Complex Solutions: Up to 2 Months.

3. Investment & Payment Terms

  • Direct Contracts: A 50% non-refundable deposit is required to commence work. The remaining 50% balance is due upon project completion and prior to final asset transfer.
  • Freelance Platforms: Projects via Upwork or Contra are subject to the respective platform’s escrow and milestone regulations.
  • Additional Work: Revisions beyond the included two (2) rounds or changes to the original scope will be billed at a standard hourly rate.

4. Intellectual Property & Ownership

  • Client Ownership: Upon receipt of final payment, the Client assumes full ownership of the website’s front-end design, code, and content.
  • Designer Rights: I retain the right to feature the completed project in my professional portfolio and marketing case studies (subject to privacy requirements).
  • Third-Party Licenses: Licenses for stock media, premium plugins, or fonts remain the responsibility of the Client.

5. Hosting & Domain Management

  • Client-Managed: You may provide your own hosting/domain credentials.
  • Fazal-Managed: If I manage your hosting, fees are billed monthly. I will provide a 30-day notice for all renewals. Failure to settle hosting fees may result in service suspension.

6. Cancellation & Refunds

  • By Client: The 50% initial deposit is non-refundable. Work completed beyond the deposit value will be invoiced proportionately.
  • By Designer: If I am unable to fulfill the project requirements, a full refund of all payments made will be issued, and all work completed to date will be transferred to the Client.

7. Liability & Warranties

  • Functionality: I warrant that the website will perform as designed across modern browsers and devices at the time of launch.
  • Limitation: My total liability is strictly limited to the total amount paid by the Client for the project. I am not liable for loss of profits, data breaches, or third-party service failures.
  • Content: The Client is responsible for the legal compliance and accuracy of all provided content (e.g., medical disclaimers, privacy policies).

8. Confidentiality & Ethics

I adhere to the high confidentiality standards required for the therapy and coaching industry. All sensitive business data shared during the project will remain strictly confidential.

9. Governing Law

This agreement is governed by the laws of Pakistan. Any disputes not resolved through direct mediation or platform-specific tools shall be settled within the jurisdiction of Pakistani courts.

By proceeding with a deposit or project kickoff, you acknowledge and agree to these terms.
